  1. Who We Are and What These Terms Cover

Second Home24 (“Second Home24”, “Second Home24.com”, “we”, “our” or “us”) is operated by Bright GLC Ltd., a company registered in the Republic of Cyprus under company number HE490719 with its registered office at Neofytou Nikolaidi 17, 8011 Paphos, Cyprus and VAT number CY60344405T.

These Terms and Conditions (“Terms”) govern your access to and use of the website located at www.second-home24.com, together with all services, software, content, listings, images, communications and features made available through it (collectively, the “Platform”).

Second Home24 operates an online property marketplace that enables professional real-estate agencies, developers and property professionals to advertise properties for sale or rent and allows prospective buyers and tenants to search for properties and contact advertisers directly.

Second Home24 is not an estate agent, broker, property developer, property manager, legal adviser, financial adviser or representative of any party in a property transaction. We do not own, inspect, verify, market, sell, rent or manage any property listed on the Platform and do not participate in negotiations or transactions between users and advertisers.

Any agreement, negotiation, reservation, purchase, rental, transaction or dispute relating to a property is solely between the advertiser and the user.

  1. Acceptance of These Terms

By accessing or using the Platform, you confirm that:

  • You have read and understood these Terms;
  • You agree to be bound by them;
  • You are at least 18 years old; and
  • You have the legal capacity to enter into binding agreements.

If you do not agree to these Terms, you must stop using the Platform immediately.

We may update these Terms from time to time. Any changes become effective when published on the Platform. Continued use of the Platform following any update constitutes acceptance of the revised Terms.

Nothing in these Terms affects any rights granted to consumers under applicable law.

  1. Use of the Platform

You may use the Platform to:

  • Search for properties;
  • Save favourite properties;
  • Create property alerts;
  • Contact advertisers;
  • Create and manage an account where available; and
  • View or print content for personal, non-commercial use.

You agree not to:

  • Use the Platform for any unlawful purpose;
  • Publish false, misleading or fraudulent information;
  • Upload unlawful, offensive, defamatory or discriminatory content;
  • Infringe intellectual property, privacy or data protection rights;
  • Publish personal information without consent;
  • Interfere with the operation or security of the Platform;
  • Introduce viruses, malware or harmful code;
  • Access another user’s account without permission;
  • Scrape, copy, extract, reproduce or mirror content from the Platform without written consent;
  • Use automated systems, bots or crawlers to access the Platform; or
  • Use the Platform in any way that may damage, disable or impair its operation.

You are responsible for any loss, damage or liability arising from your misuse of the Platform.

  1. User Accounts and Security

Where registration is required, you are responsible for maintaining the confidentiality of your login credentials.

You are responsible for all activities carried out under your account.

You must notify us immediately if you become aware of any unauthorised access to your account or any security breach.

We reserve the right to suspend or terminate accounts that violate these Terms.

  1. Advertisers and Property Listings

Only approved professional estate agencies, developers and property professionals may advertise on the Platform. Private sellers, private landlords and private individuals may not advertise unless expressly authorised by Second Home24.

Advertisers must provide accurate and complete business information and keep it updated at all times.

By publishing a listing, an advertiser confirms that:

  • It is authorised to advertise the property;
  • The property genuinely exists and is available;
  • All information is accurate and up to date;
  • All photographs and marketing materials may lawfully be used;
  • The listing complies with all applicable laws and regulations.

Advertisers are solely responsible for their listings and the accuracy of all information provided.

Advertisers must not:

  • Publish false or misleading information;
  • Advertise unavailable properties;
  • Publish duplicate listings;
  • Manipulate prices;
  • Use irrelevant, misleading or watermarked images;
  • Include contact details within listing descriptions;
  • Artificially influence rankings or search results.

We may remove, edit, suspend, restrict or reject any listing where we reasonably believe it violates these Terms, applicable law or the integrity of the Platform.

  1. No Verification of Listings

Second Home24 does not verify ownership, legal title, planning permissions, licences, property measurements, descriptions, photographs, pricing, availability, energy certificates or any other information contained within listings.

Although we may perform checks on advertisers, we do not guarantee the accuracy, completeness, legality or reliability of any listing.

Users should independently verify all information and seek professional legal, tax, financial or technical advice before making any property-related decision.

  1. No Professional Advice

Information available on the Platform is provided for general informational purposes only.

Nothing on the Platform constitutes legal, tax, investment, financial, property, valuation or professional advice.

Any reliance placed on information obtained through the Platform is entirely at your own risk.

  1. Fees, Subscriptions and Paid Services

Certain services may be offered for a fee, including advertising packages, subscriptions, featured listings and promotional services.

All fees displayed on the Platform are payable in advance unless otherwise agreed.

Unless required by applicable law, fees are non-refundable once a service has been activated.

Failure to pay applicable fees may result in suspension, removal or downgrade of listings and services.

  1. Listing Rankings and Featured Placements

Search results and listing rankings may be influenced by various factors including location, listing quality, completeness, freshness, user preferences, relevance and paid promotional features.

Featured or sponsored listings may receive increased visibility within search results and other areas of the Platform.

  1. Intellectual Property

The Platform and all associated software, content, branding, logos, graphics, databases, text and design elements are owned by Second Home24, Bright GLC Ltd. or their licensors and are protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, republish, sell or exploit any part of the Platform without prior written permission.

By uploading content to the Platform, advertisers grant Second Home24 a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, publish, distribute and promote such content in connection with operating and marketing the Platform.

  1. Third-Party Content and Links

Listings, advertisements and content published by advertisers or third parties are not created, controlled or verified by Second Home24.

We are not responsible for the accuracy, legality or reliability of such content.

The Platform may contain links to third-party websites. We do not control those websites and accept no responsibility for their content, products, services or privacy practices.

  1. Reporting Unlawful Content

If you believe that content on the Platform is unlawful, misleading, fraudulent or infringes your rights, you may report it using the contact details provided below.

We will review reports and take appropriate action in accordance with applicable law, including the Digital Services Act (Regulation (EU) 2022/2065).

  1. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Second Home24 makes no warranties, representations or guarantees regarding the accuracy of listings, availability of properties, uninterrupted access to the Platform, security of the Platform or freedom from errors, viruses or defects.

Use of the Platform is entirely at your own risk.

  1. Limitation of Liability

To the fullest extent permitted by law, Second Home24 shall not be liable for any indirect, incidental, special or consequential losses, including loss of profits, revenue, business opportunities or data.

We are not responsible for disputes between users and advertisers, inaccuracies in listings, property transactions or actions taken by advertisers or third parties.

Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.

  1. Indemnity

You agree to indemnify and hold harmless Second Home24, Bright GLC Ltd., its directors, officers, employees, affiliates and service providers from any claims, liabilities, damages, losses, costs and expenses arising from your use of the Platform, your content, your listings or your breach of these Terms.

  1. Privacy and Cookies

We process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

  1. Suspension and Termination

We may suspend, restrict or terminate access to the Platform where these Terms are breached, unlawful activity is suspected, security concerns arise or we decide to discontinue all or part of the Platform.

We may also remove, archive or deactivate listings that have expired, been sold, rented, withdrawn or are no longer current.

  1. Force Majeure

Second Home24 shall not be liable for any delay, interruption or failure resulting from circumstances beyond our reasonable control, including natural disasters, internet outages, cyberattacks, governmental actions, labour disputes, power failures or failures of third-party service providers.

  1. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Cyprus.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Cyprus, except where mandatory consumer protection laws provide otherwise.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
